Labour Court dismisses Agnieszka Jemiola’s appeal over public-holiday benefits

The Labour Court dismissed Agnieszka Jemiola’s appeal against the Rights Commissioner’s decision on public-holiday benefits claimed from Sparantus Ltd T/A Highfield Healthcare. The determination was signed on 27 November 2014. Jemiola said she received less favourable treatment because she did not get a benefit for certain public holidays. The Court said the claim could not succeed because it was not based on the treatment of an identifiable comparable full-time employee; the part-time work law also did not displace the separate public-holiday rules.
