The Labour Court dismissed security guard Tomasz Dojlida’s appeal against Noonan Services Group Ltd, affirming the Rights Commissioner’s decision. The determination was dated 28 October 2014. Dojlida said his hours were reduced after Noonan lost a contract while full-time guards were made redundant. He sought redundancy instead of continued work on reduced hours and wanted his hours brought into line with full-time guards. The Court found that the Act did not give him a right to redundancy instead of continued employment, or an entitlement to the same working hours as a full-time comparator. It noted that the comparator’s hours had also been reduced, though by less.
