The Labour Court dismissed appeals by William Tracey, Thomas Hennessy and Patrick Carney over their exclusion from the ESB’s Employee Share Option Scheme. It found their claims were brought outside the six-month time limit and that it had no jurisdiction to hear them; the merits were not decided. The claimants said the ESB excluded them because they worked part-time. The Court held that the time limit began when the scheme closed without including them, by 28 May 2003 at the latest. Their complaints were presented on 6 December 2010. The determination was signed on 2 May 2012.
