Labour Court disallows ESB part-time workers’ share scheme appeal

The Labour Court disallowed an appeal by William Tracey, Thomas Hennessy and Patrick Carney over ESB’s Employee Share Option Scheme. The determination was signed on 2 May 2012. The three workers said their part-time status had excluded them from the scheme. The Court found it had closed to new participants by 25 February 2002, with the final share allocation made on 28 May 2003. Their claims, lodged in December 2010, were outside the six-month time limit. The Court affirmed the Rights Commissioner’s decision that it had no jurisdiction to hear them; the merits were not decided.
