The Labour Court allowed an appeal by Job Sharers represented by the Services Industrial Professional Technical Union over public holiday pay at Bausch & Lomb. Job Sharers who normally worked on the holiday were entitled to eight hours’ pay; those who did not normally work that day were entitled to four hours’ pay. The determination was signed on 8 August 2005. The appeal challenged a Rights Commissioner’s decision that had accepted the company’s calculation method. The Labour Court found that decision incorrect to the extent that it differed from the entitlements in the holiday pay rules. It limited backdated claims to public holidays after February 2004 and amended the decision accordingly.
