The Labour Court has overturned a finding in Jane Crowe’s favour, ruling that Debenhams Retail (Ireland) Limited complied with its duty to provide information during collective redundancy consultations. The Court’s decision was dated 10 April 2024. Crowe, a shop assistant, argued that consultation should have begun when redundancies were being considered and that workers’ representatives lacked information to explore alternatives. Debenhams said it provided information relevant to the proposed redundancies and was not required to disclose all business details or its legal advice. The Court considered the union’s questions about leases, stock, the online business, finances, landlords and store performance. It concluded the employer met its duty under section 10 of the Protection of Employment Act 1977 and set aside the Adjudication Officer’s earlier decision that Crowe’s complaint was well founded.
