The Labour Court found Andrew Connell’s penalisation claim against Enterprise Ireland not well-founded and dismissed his appeal. The decision was dated 11 April 2018.
Connell alleged that he made protected disclosures to Enterprise Ireland and to the Minister for Jobs, Enterprise and Innovation, and that he suffered six instances of penalisation. He cited losing an internal promotion competition and being relieved of responsibility for supervising a Technology Centre. Enterprise Ireland denied receiving protected disclosures or penalising him.
Only the first two alleged incidents were covered by the original complaint; the other four happened later. The Court found Connell had not substantiated that either covered incident would not have occurred but for the matters he raised. It did not decide whether those matters qualified as protected disclosures, and affirmed the Adjudication Officer’s decision.
