Labour Court rejects Stephen Connolly’s appeal over alleged penalisation

The Labour Court rejected Galway County Council worker Stephen Connolly’s appeal over alleged penalisation for making a protected disclosure. The Court dated its determination 19 February 2018.

Connolly said delays involving payments, his retirement gratuity and annual leave were linked to a disclosure he said he made in September 2014. Galway County Council denied penalising him and disputed that he had made a protected disclosure.

The Court found Connolly had not provided specific details of the four administrative matters or established the primary facts and a causal link to the alleged disclosure. It found he was not penalised under section 12(1) of the Protected Disclosures Act, 2014, and the appeal failed. The Court varied the Adjudication Officer’s earlier decision, which had found the complaint out of time and outside its jurisdiction.
