The Labour Court dismissed James Murphy’s appeal over his protected-disclosure complaint against AIB, affirming the Adjudication Officer’s decision that it was out of time. The Court’s determination was signed on 8 February 2018.

Murphy said he had been victimised for making protected disclosures and cited workplace issues including a declined credit card and a downgraded performance review. AIB argued that the issues were not protected disclosures and were historic.

The Court considered whether Murphy had identified a protected disclosure during the period from 15 March to 14 September 2016. After an adjournment, he could not identify one within that period. The Court found no protected disclosure had been made during the period and dismissed the appeal. The complaint was brought outside the time limit and was not well founded; the merits were not decided.
