The Labour Court upheld the decision against Keith O’ Reilly in his penalisation appeal against QFF Distribution Limited. The determination was dated 3 November 2017. The Court found the complaint was brought outside the time limit and was not well founded; the merits were not decided. O’ Reilly, a Sales Office Assistant, resigned on 25 September 2015. He said stress and anxiety after leaving justified the delay. QFF pointed to his alternative employment within two to three weeks and a Payment of Wages complaint he filed on 21 October 2015. The Court found he had not shown a justifiable excuse, noting that he had been able to bring that other complaint.
