The Labour Court quashed a jurisdiction decision on 4 October 2016, allowing Michael Sheils’s pension discrimination claim to proceed to investigation. Sheils had appealed an Equality Tribunal ruling that earlier civil proceedings barred his complaint. The Court found it was more likely than not that an undertaking had been given in the Supreme Court proceedings that Boliden Tara Mines and the Tara Mines Pension Scheme would not argue those proceedings had decided allegations under the Pensions Act or concerning inequality. It ruled the complaint was not barred by the earlier litigation and sent it to the Workplace Relations Commission for a substantive investigation. The Court did not decide whether discrimination occurred.
