The Labour Court upheld a decision rejecting Marek Bartosik’s minimum wage complaint against Citi Bus Ltd, dated 9 June 2023. Bartosik said unpaid time during breaks in Dublin, when he carried collected cash, brought his hourly pay below the minimum rate.
Citi Bus said its €105 daily rate was assessed against an eight-hour day and that drivers were free during breaks. The Court found no breach of the National Minimum Wage Act, saying unpaid break time did not have to be included in the hourly rate calculation. Bartosik’s appeal failed.
