The Labour Court varied Imtiaz Khan’s minimum-wage arrears award to €22,439.25 after Imtiaz Ranjha, in the style and practice of Sky Solicitors, lost his appeal. The determination was dated 6 July 2021. An Adjudication Officer had awarded Khan €24,155.31.
Khan said he regularly worked 50 to 60 hours a week or more but was not paid the minimum wage. Ranjha disputed that Khan was an employee, challenged his account of his hours and argued the complaint was out of time. The Court found Khan was an employee from 7 August 2017 to 5 October 2018 and that no time-limit issue arose.
The Court preferred Khan’s account of his hours, supported by a note signed by his training solicitor. Ranjha had kept no records of Khan’s hours or pay and failed to prove compliance with the Act. The Court accepted Khan’s calculation of arrears and required Ranjha to pay €22,439.25 within six weeks. Khan’s separate statutory leave claim was not allowed because little or no details had been provided.
