The Labour Court overturned a Rights Commissioner decision in Tansey Transport Limited’s appeal over Marek Rog’s national minimum wage complaint. The Court found that Rog’s requests for pay information concerned periods after his employment ended, so he had not met a statutory condition for referring the dispute. Whether he was paid the national minimum wage was not decided. Rog told the Court he ended his employment by telephone on 28 September 2012. The Court determined that his employment ended immediately after the call and that both requests related to later periods.
