Labour Court overturns decision and awards truck driver €5,959.95 in wage arrears

Labour Court ·

The Labour Court set aside a Rights Commissioner’s decision and awarded truck driver Egidijus Zebelys €5,959.95 in national minimum wage arrears on his appeal against O’Leary International Ltd. The determination was signed on 3 March 2014. Zebelys worked from the company’s premises in New Ross, Co Wexford, and was paid €60.55 a day, or €302.75 a week, alongside subsistence payments. The Court found his contract required him to be available for up to 48 hours a week. Tachograph records did not reliably show all working time, including official travel and overnight periods when he could be required to work. The Court found he had not received the minimum wage and directed the company to pay the arrears.
