The Labour Court reduced a €11,262.50 minimum-wage arrears award against Eamonn Morrissey, trading as Valcon International Transport, to €96.75 after his appeal partly succeeded. In a determination dated 21 November 2014, the Court found driver Girts Miltovics had been underpaid by €46.75 and upheld a separate €50 expenses award.
Miltovics said he usually worked 50 hours a week and that €300 of his €600 weekly pay was treated as travel and subsistence. Morrissey disputed the hours and argued that €450 should count as wages. The Court rejected his reliance on tachograph records, finding they did not show the hours Miltovics was contracted to work. It also found Morrissey had not kept the records required to prove compliance.
The Court calculated the underpayment over 85 weeks and ordered Morrissey to pay €96.75 within six weeks. It found that only €300 of the €431.95 gross weekly amount it treated as wages had been declared to Revenue, and said it would send the determination to the Revenue Commissioners for appropriate action.
