The Labour Court struck out Four Star Pizza’s appeal, leaving a €1,250 award to Waqar Saeed Khan in place. The determination was signed on 29 June 2011. Khan had worked as a pizza delivery driver from 25 June to 3 September 2009. He said he was paid €5 an hour plus €1.50 per delivery, and sought the €8.65 hourly minimum wage. The Rights Commissioner found a €992.75 wage shortfall and awarded €1,250, including expenses connected with the complaint. Four Star Pizza appealed, but did not attend the Labour Court hearing to move the appeal. The Court struck it out for want of prosecution; the merits of the appeal were not decided.
