The Labour Court allowed Mauro Sanna’s appeal against a Rights Commissioner decision and awarded him €9,174 in gross unpaid wages. The determination was signed on 9 May 2011. Sanna worked as a barperson for Spring Manor Trading As Unicorn Restaurant from 12 April 2008 to 16 October 2009. He said he had been underpaid and had worked more hours than the employer claimed. The Rights Commissioner had found the complaint failed because the required wage statement had not been requested. The Labour Court accepted Sanna’s evidence that he had requested a statement of earnings and that it was not provided. It found he had worked for 79 weeks, averaging 44 hours a week, and concluded that he was underpaid by €9,174. The Court allowed the appeal and awarded that amount in arrears under the National Minimum Wage Act 2000.
