Labour Court overturns Rights Commissioner decision and awards Otylia Mika €5,933.20

By Aoife Loughran

Labour Court ·

The Labour Court allowed Otylia Mika’s appeal and set aside the Rights Commissioner’s decision, ordering Café Rossini Ltd to pay €5,933.20 in minimum-wage arrears and €567 in expenses. The determination was signed on 15 February 2010. Mika claimed she had been underpaid between 2005 and 2007. Her records showed the shortfall, and the respondent offered no evidence. The Court accepted her uncontested evidence and substituted its determination for the Rights Commissioner’s decision. The case listing spells the respondent’s name Ristorante Rossini.
