The Labour Court increased chef Shiv Kumar’s arrears award against Tandoor Ltd from €6,100 to €26,521.77 after finding that he had been underpaid the national minimum wage. Its determination was signed on 4 October 2010.
Kumar appealed the Rights Commissioner’s calculation, saying he had worked 62 hours a week until 8 November 2008 and 45 hours a week after that. He said Tandoor required him to return €46 from weekly pay shown as €346. The company did not attend the hearing.
The Court found no plausible explanation for the deductions and ordered Tandoor to pay €26,521.77 within six weeks. The earlier €6,100 award was replaced, not added to the new amount.
