The Labour Court upheld the Rights Commissioner's decision and rejected Vytautas Jurksa's appeal over an alleged minimum-wage breach. The determination was dated 10 March 2008. Jurksa, a receptionist and housekeeper at Harbour House Limited, said he received €225 for a 48-hour week and €350 for a week of up to 79 hours. The company said it had paid the minimum wage and made the correct tax and PRSI deductions. The Court found Jurksa had not requested the written pay-rate statement required before referring the dispute and said it would normally decline jurisdiction on that basis. It nevertheless examined the claim on this occasion and found no breach; Jurksa accepted there had been no breach during the six-month period covered by the time limit and did not seek an extension.
