The Labour Court overturned a Rights Commissioner’s dismissal of Linda Argule’s minimum wage claim and directed Anna & Geraldine Hughes to pay her €3,912. The determination was dated 6 November 2007.
Argule worked as a florist for the company from 11 August 2005 to 12 May 2006. She said she was paid €5 an hour, below the €7.65 minimum wage. The company disputed the number of hours she worked and said she received extensive florist training. The Court found an underpayment of €3,912.
The Rights Commissioner had dismissed the claim for lack of prosecution after Argule was late for the hearing. She appealed, citing medical reasons for her lateness. The Labour Court upheld her minimum wage complaint.
