The Labour Court allowed Fatima Oulidi's appeal and directed O'Sullivan & Maguire Ltd. T/A The Georgian Hotel to pay €1,040 in wage arrears and €200 in expenses, a total award of €1,240. The determination was dated 8 May 2006. Oulidi, a housekeeper at the hotel, challenged her pay for work from February 2001 to December 2004. The Court accepted her evidence that she worked 40 hours a week and that her half-hour break counted as paid working time. It found the hotel failed to apply the increase in the minimum hourly rate from €6.35 to €7 from 1 February 2004. The Court calculated arrears for the period from 1 February to 7 December 2004, when her employment ended. The Rights Commissioner had not upheld the complaint, but the Labour Court found it well founded on appeal.
