The Labour Court set aside a Rights Commissioner’s decision and awarded Rita Gedminaite €1,047.05 in minimum-wage arrears and €150 in expenses. The determination was dated 9 September 2002, after she appealed the decision to strike out her complaint when she did not attend the Rights Commissioner hearing. Gedminaite worked as a waitress at the Ivory Hotel in Waterford. The Court accepted her account that she stopped using the hotel’s board and lodgings after 30 June 2001. It found her pay fell below the national minimum wage for the hours she worked after that date, and calculated €1,047.05 in arrears for 833.25 hours. The total payable was €1,197.05.
