The Labour Court upheld the decision that Ms Svetlana Grodzicka’s minimum notice complaint against Astra Leisure & Ultra Fresh Services Limited was brought outside the time limit. The determination was dated 2 May 2023; the merits were not decided. Ms Grodzicka argued that Astra Leisure had ended her employment during maternity leave without telling her and that she expected to return to work. The Court found her employment ended on 11 March 2020 and that she knew this by 1 April, when she saw her Revenue account and her manager confirmed it. It rejected July and September as relevant dates and found no reasonable cause to extend the deadline. The Court also noted that she had lodged a separate discrimination complaint within time.
