The Labour Court set aside an Adjudication Officer’s decision and ordered Tesco Ireland Ltd to pay Rose Kinsella six weeks’ wages in lieu of notice. The Court dated its decision 14 May 2019.
Ms Kinsella appealed after the Adjudication Officer found her dismissal fair and said she was not entitled to notice or pay in lieu. In a separate appeal, the Labour Court had found Tesco’s dismissal of her for gross misconduct unfair. It therefore found her minimum notice complaint well founded and ordered the six weeks’ pay.
