The Labour Court upheld a decision rejecting Mr Danilo Marchese’s minimum-notice claim against Apple Distribution International Ltd. The determination was dated 21 October 2019. Marchese pursued a claim for 4.15 hours under the Minimum Notice and Terms of Employment Acts, although he did not dispute that he had received his full legal entitlement to payment in lieu of notice.
Apple said it had met its obligations by paying Marchese four weeks’ pay in lieu of notice. His representative could not identify a provision of the Act that allowed him to pursue the 4.15-hour claim under that legislation. The Court described the claim as misconceived and said it must fail.
