The Labour Court affirmed an award of four weeks’ pay in compensation to Mr Ali Selim after finding that Trinity College Dublin had not shown it gave him statutory notice when his employment ended. The determination was dated 11 September 2019.
Selim appealed an Adjudication Officer’s decision under the Minimum Notice and Terms of Employment Acts. The parties agreed he was entitled to four weeks’ notice. The Adjudication Officer had found that he did not receive it and set compensation at a weekly rate of €411.
Trinity College Dublin submitted that the Head of its School of Languages told Selim on 1 September 2018 that his services would no longer be required. The Court had no evidence of what was said or whether a definite termination date was communicated. An email confirming that his services had ceased was sent on 5 October 2018, after his employment ended. Selim said he received no communication about the termination on 1 October. The Court found no evidence that notice of the termination had been provided and affirmed the original decision.
