The Labour Court allowed Euro Car Parks (Ireland) Limited’s appeal and set aside the finding that Dermot Kelly’s minimum-notice complaint was well-founded. The decision was signed on 18 May 2018. The Adjudication Officer had found the complaint well-founded after concluding no transfer had occurred when the company’s contract to run Paul Quay Car Park in Wexford ended on 14 November 2016. In a related appeal, the Labour Court determined that a transfer had taken place by operation of law. Kelly did not attend the appeal hearing, and his solicitors told the Court he would not contest the appeal.
