The Labour Court allowed Argos Distributors (Ireland) Ltd’s appeal and set aside the Adjudication Officer’s findings that Padraic Dunne’s unfair dismissal and minimum notice claims were well-founded. The determination was dated 21 November 2017. The earlier decision had not upheld his redundancy claim.
Dunne said he sought weekend hours so he could study accountancy at college. Argos said it could not accommodate his request for 15 weekend hours, but proposed unpaid leave while his timetable was settled or weekend work during the pre-Christmas period. The Court found that a reasonable person in Dunne’s position would not have considered himself dismissed and that Argos had made reasonable proposals to retain him.
