The Labour Court recommended that A Garda resubmit his claim to have an absence after surgery in August 2023 classified as a continuation of injury-on-duty leave. The Court issued its recommendation on 6 July 2026, following an appeal by An Garda Síochána. The garda said the surgery followed injuries sustained in a 2020 road traffic collision while driving an official vehicle. Management said the Chief Medical Officer had not found a causal connection between the injury and surgery. The Court said the dispute concerned the decision-making process under Garda Code 11.37.
