The Labour Court recommended that the Health Service Executive Cregg Service pay an anonymised worker any money due for performing higher duties from 2014 to 2017, plus €3,500 compensation. The recommendation was signed on 7 April 2021. The worker, represented by Forsa, said he had taken on Executive Chef duties after the Catering Officer went on career break in 2014 but was not paid the appropriate rate. He signed a contract for the higher role under protest in June 2017, and the arrangement continued after the contract expired in April 2019. The Court said the case had circumstances identical to a colleague’s earlier case and recommended the same terms: payment of any money due for the higher duties and €3,500 compensation for the unsatisfactory situation in which the employer had placed the worker.
