The Labour Court recommended that a worker enter the Health Service Executive (HSE) pension scheme from 1 May 2007, with pensionable pay set at €47,378 and adjusted retrospectively. The recommendation was signed on 9 March 2021. The HSE had proposed pensionable pay of €38,757, while the worker sought €56,000, arguing that her full-time equivalent rate was €80,888. The Court said neither side had identified an objective basis for setting the rate and noted there was no approved scale for the role. It also recommended a non-pensionable allowance equal to the difference between pensionable pay and the worker’s rate of pay. Before implementation, the worker is to receive details of the contributions and deductions arising from scheme entry. She agreed to be bound by the recommendation.
