The Labour Court recommended that Sean Fergus accept HSE West’s offer of an on-call allowance worth €1,157 a year, backdated to December 2016. Its decision was dated 22 February 2021. Fergus, represented by the Services Industrial Professional Technical Union, had sought an allowance dating to October 2013. HSE West said Fergus covered winter gritting about five times a year and received overtime for call-outs. It offered three months of continuous on-call payments each year, from December to February. The Court found the offer reasonable and fair and recommended it in full and final settlement of the claim.
