The Labour Court recommended that Ms Karen Daly return to a Band 1 position at her former branch, or as near as possible, when medically fit. Its recommendation, dated 27 January 2021, also said the 2017 decision by The Governor and Company of the Bank of Ireland, Bank of Ireland Group PLC to place her on special paid leave should be accepted as reasonable and in line with the procedures then in place. Daly was represented by the Financial Services Union.
Daly appealed an adjudication officer’s recommendation to commute a final written warning to a written warning for 12 months. The Labour Court noted that the special paid leave decision followed the bank’s procedures, was reviewed and caused no financial loss. The disciplinary penalty had expired and been expunged from her record.
The Court recommended that the parties engage when Daly was fit to return, with the aim of securing a Band 1 position at her former location or as near as possible.
