The Labour Court recommended €5,000 compensation and a possible appointment to a Grade VI vacancy for an anonymous worker at the Health Service Executive, varying an earlier recommendation on the HSE’s appeal. The decision was dated 12 July 2019. The worker said she was appointed to a Grade VI role in 2013 but returned to Grade III in 2017. The HSE said the role had been advertised as a redeployment at her existing grade and terms. The Court agreed with the HSE’s position on the advertisement, but noted that she had carried out Grade VI duties for more than four years and had not been informed about a circular relevant to temporary higher-grade pay. The Court recommended appointment to a Grade VI vacancy if one arose within two years after she returned to work. The HSE also committed to correcting her Grade III pay point and restoring her training allowance.
