The Labour Court declined to consider a union recognition and terms dispute brought by the National Bus & Rail Union on behalf of drivers at Vantastic Limited. Its determination was dated 14 June 2019. The Court said it had no jurisdiction under the Industrial Relations (Amendment) Act 2001 because the union accepted that Vantastic practised collective bargaining for the drivers concerned. The union also did not provide the statutory declaration or other information the Court needed to assess whether the number of workers in the dispute was significant. The Court said the Act did not allow it to recommend collective bargaining arrangements and concluded that the application was misconceived.
