The Labour Court recommended that an on-call allowance apply to five Commission For Railway Regulation inspectors from 1 April 2018. The recommendation, dated 15 March 2019, followed a claim brought by Forsa on their behalf. The inspectors take part in rosters to respond to railway accident notifications, with each on-call period lasting from Friday afternoon to the following Friday. Forsa sought the allowance retrospectively from the inspectors’ employment start dates in 2015 and 2016. The Commission For Railway Regulation argued their salary scale included the allowance and that it could not change their terms without ministerial authorisation. The Court noted that the inspectors participated in the roster and that the employer accepted the original rationale for paying the allowance still applied.
