Labour Court recommends permanent posts for five HSE employees in higher-grade roles

The Labour Court recommended permanent appointments for five Health Service Executive employees at the higher grades they had held temporarily since at least 2013. The recommendation was dated 13 August 2018 and applies only to these five employees. FRsa argued they had filled an ongoing need and had developed an expectation of permanency. The HSE said they were on temporary specified-purpose contracts and should compete for permanent roles.

The Court found that the appointments had continued beyond 12 months after a 2013 agreement, without an exceptional basis, and were inconsistent with that agreement and circular 17/2013. It also noted that the HSE had raised concern about similar cases but had provided no detail, and that the issue had not been discussed nationally. The Court recommended permanent appointments at the grades the five had temporarily held since at least 2013, taking effect when the recommendation is accepted.
