Labour Court rejects worker’s appeal over Senior Technical Officer competition

The Labour Court rejected a worker’s appeal over access to a Senior Technical Officer competition at the Institute Of Art Design And Technology (Iadt), finding the circular interpretation issues were collective and outside the section 13(9) appeal route. The Court’s recommendation was signed on 9 August 2018. The worker, represented by Unite the Union, argued that revised rules applied to first fillings of posts that had been advertised but left vacant and later re-advertised. IADT said it had followed the relevant circulars. The Labour Court said interpretation of the circulars raised collective issues that were not properly before it under section 13(9) of the Industrial Relations Act 1969. The appeal failed, and the Court varied the Adjudication Officer’s recommendation accordingly.
