The Labour Court recommended that the Health Service Executive pay €10,000 compensation to an anonymised worker and support him with the cost and study time for a new qualification. The recommendation, dated 14 March 2018, amended an Adjudication Officer’s recommendation after the worker appealed.
An internal review found that the worker had been treated unfairly after he was removed from an acting post while the vacancy continued to exist. The Psychiatric Nurses Association sought his reinstatement, saying the earlier compensation did not cover his losses. The Health Service Executive accepted the internal report and the Adjudication Officer’s recommendation, but said another person had been acting in the post since July 2016.
The Court recommended implementing the internal report. If the worker pursued the required qualification, the employer should provide financial support and study time, including five additional days of study leave over the course. It also recommended €10,000 compensation.
