Labour Court rejects worker’s 25% acting-up allowance claim

By Donal Gilhooly

Labour Court ·

The Labour Court found that a worker’s claim for a 25% acting-up allowance at Valeant Pharmaceuticals Ireland Bausch & Lomb was not well-founded. Its recommendation was signed on 23 February 2018. The worker said he performed stand-in manager duties from early 2012 until March or April 2015 because colleagues appointed to the role were not fully trained. He had received the allowance during acting-up periods in 2010 and 2011. The company disputed that he was acting up and said he had not used its formal process for claiming the allowance. The Court noted he had used that process before and upheld the Adjudication Officer’s recommendation.
