Labour Court affirms €7,500 payment and recommends worker return to Western Care facility

Labour Court ·

The Labour Court affirmed a €7,500 payment to a worker and recommended that she return to her post at Western Care Association’s facility in Ballyhaunis, Co Mayo. The recommendation was dated 30 November 2017, after the employer appealed an adjudication officer’s recommendation. The union argued that Western Care had breached its disciplinary policy and imposed sanctions without foundation. The employer said it investigated the matter and issued a sanction under its procedure. The Court said the worker should return without loss of status or income. It found the €7,500 payment reasonable and proportionate, payable after she resumed work. The disciplinary sanction had expired and been removed from her record. The Court recommended a full and final settlement and set aside the adjudication officer’s recommendation.
