Labour Court finds Aer Lingus worker’s dismissal was not unfair

By Tadhg O'Sullivan

Labour Court ·

The Labour Court recommended that a cabin crew member’s dismissal by Aer Lingus was not unfair, in a recommendation signed on 9 November 2017. Aer Lingus dismissed the worker after breath tests showed alcohol levels above its limit while she was due to work in a safety-critical role. She challenged the reliability of the tests and said the company had not conducted a thorough investigation. Aer Lingus said it followed its policy and afforded her fair procedures. The Court found the disciplinary process substantially complied with the company’s policy and gave the worker appropriate procedural protections. It concluded that her dismissal was not unfair and recommended that her claim was not well founded.
