Labour Court recommends new investigation into Dublin City Council disciplinary case

The Labour Court recommended that Dublin City Council set aside the outcome of a disciplinary procedure involving a worker represented by the Services Industrial Professional Technical Union and conduct a new investigation. The recommendation was signed on 1 September 2017. The dispute concerned sanctions after an investigation found that the worker had threatened a colleague. The Court found that the decision maker considered material that had not been disclosed to the worker, and that the process fell short of the standards required for grave allegations. Dublin City Council also admitted treating the worker differently because of his history of bringing grievances to the Labour Court. The Court recommended an independent investigation and said the worker should receive relevant information and an opportunity to make submissions if charges are brought.
