Labour Court upholds An Post transfer recommendation after union appeal

The Labour Court upheld an Adjudication Officer’s recommendation that a worker’s transfer from Rathmines depot to Whitehall depot was reasonable. The decision was signed on 21 July 2017, and the Communications Workers Union’s appeal on the worker’s behalf failed. The union argued that the transfer harmed the worker and amounted to a demotion because he lost seniority at the new depot. An Post said his terms and conditions were unchanged. Management decided not to dismiss him and issued a final written warning due to expire on 9 October 2018; after that, he could apply for vacant duties in other depots in the normal way.
