Labour Court recommends full redundancy package for former ACC worker

The Labour Court recommended that a worker receive the full agreed redundancy package from ACC Loan Management DAC (Formerly ACC Bank PLC), despite leaving for another job before the severance terms were finalised. The recommendation was signed on 4 July 2017. The worker, represented by the Services Industrial Professional Technical Union, said management had assured him his redundancy application would be supported. The employer, represented by the Irish Business and Employers’ Confederation, argued that an earlier Labour Court recommendation had already dealt with the issue. The Court found he could pursue the claim because he had referred the matter to a facilitator for guidance rather than binding arbitration. It recommended the same package received by three former colleagues: 5.5 weeks per year of service, including statutory entitlements, based on nine years’ service.
