The Labour Court recommended that Limerick City and County Council uphold an Adjudication Officer’s recommendation on a retired worker’s pension calculation. The recommendation was dated 19 May 2017 and followed the council’s appeal. The worker, represented by the Services Industrial Professional Technical Union, said regular weekend and public holiday overtime during his career should have counted towards his pension. The council argued the overtime was voluntary. The Court found it was not optional, was regular and recurring, and formed part of the worker’s employment. It recommended that the Adjudication Officer’s recommendation be upheld.
