Labour Court recommends Norma Gray accept employer’s justification for different pay rates

The Labour Court recommended that Norma Gray accept Bilfinger HSG Facility Mangement Ltd’s justification for paying different rates to colleagues doing the same work. The recommendation was dated 10 February 2016. Gray said colleagues doing the same duties were paid more and that management had not responded when she raised the issue. The employer said pay rates followed the industry ERO and that employees had transferred on different terms. The Court accepted that transfers of undertakings had left some colleagues on higher, “red-circled” rates and found the employer’s practice reasonable.
