The Labour Court recommended that Dunnes Stores rescind a worker’s disciplinary sanctions, repay €464.96 deducted during a five-day unpaid suspension and restore him to the sick pay scheme. The recommendation was signed on 17 January 2017. The worker said his absences were related to injuries from a road traffic accident and that the sanctions were too severe. Dunnes Stores did not attend the hearing or send its position in correspondence. The Court found that the company had not followed its own procedures and that the worker’s one-day uncertified absence did not warrant the sanctions. It recommended rescinding them in full, reimbursing one week’s lost wages and restoring his sick pay scheme membership.
